We act for many Landlords of commercial properties, and Managing Agents, in the collection of unpaid rents which are due under the terms of a lease.
From 6 April 2014, Landlords can no longer distrain on behalf of themselves or their company and Distress can be levied by a Certificated Bailiff in compliance with the new rules.
In many cases, we can assist Landlords to take peaceful possession of commercial premises with the assistance of a Certificated Bailiff, but it will be necessary to recover rents through the courts.
If requested, we are able to undertake to arrange to meet a locksmith at the premises, with the Landlord, usually at a very early hour to avoid any confrontation. But if we are informed that there could be a problem with the tenant; we arrange for the police to attend as they will only attend if there is a possibility of a breach of the peace.
After many years talking about amending the outdated rules covering distress; the Ministry of Justice has got their act together and finally implemented many changes and our blog posted on 6 February details the major changes.
