We act for many Landlords of commercial properties, and Managing Agents, in the collection of unpaid rents which are due under the terms of a lease.

Distress can be levied on any day of the week (including Sundays), between the hours of sunrise and sunset only.

No Court Order is required, as Distress is  Common Law going back hundreds of years, and there are strict rules what unpaid debts for which a Certificated Bailiff can collect. They are not allowed to collect for unpaid rents from a residential tenant.

They cannot break into premises, but can enter through an open window or door. This is usually undertaken with no cost to our Client as the costs are borne by the debtor. 

In many cases, we are also instructed to take peaceful possession of commercial premises under Common Law forfeiture, but it will be necessary to recover rents through the courts. 

We undertake to arrange to meet a locksmith at the premises, usually at a very early hour to avoid any confrontation. But if we are informed that there could be a problem with the tenant; we arrange for the police to attend as they will only attend if there is a possibility of a breach of the peace.
